Can I share data with a third party?

What do I need to do to share data with a third party?

You must have the legal right to share the data with the Third party. If the data belongs to you or you have proper authorization from the data owner, you can share it with others.

Identify Third Parties:

Get the list of the third parties from the Business Development Team or the clients. Share the TPA request with third parties.

Legal Team Review:

Share the completed TPA Request form with your legal team. The legal team will review the details to ensure compliance with data protection laws and other relevant regulations. The legal team will use this information to draft the actual Third-Party Agreement.

Purpose of Data Sharing:

Clearly define the purpose for which you are sharing the data with the third party in the TPA request form. Explain the specific reasons for sharing the data and how the third party intends to use it. This purpose should align with the requirements and expectations of the data subjects.

Data Sharing Agreement (Third-Party Agreement):

Once the legal team reviews the TPA request form, they will create the formal data-sharing agreement, also known as the Third-Party Agreement. This document should outline all the terms and conditions of data sharing, including responsibilities, liabilities, data handling procedures, and confidentiality obligations.

Data Security Measures:

In the Third-Party Agreement, specify the data security measures that the third party must implement to protect the data during transfer and storage.

Review and Update:

Periodically review the data-sharing agreement to ensure it remains current and aligned with any changes in regulations or business requirements. Update the agreement as necessary to reflect any modifications in the data-sharing arrangement.

Maintain Records:

Keep detailed records of the TPA request form, the Third-Party Agreement and any communication related to data sharing.
